legal question about selling items on ebay?

i wrote my own disclaimer for computers i sell on eBay. so lets so for example someone is unhappy with my item. or someone tries to modify my item like over clocking the processor way too much in the computer that i sold them. and lets say that the computer overheats due to the over clocking they did. and the computer catches fire and the house catches fire... am i covered by stating this at the bottom of my instructions page?? Disclaimer* "If this processor is overclocked passed the tested speed of 3.6Ghz Digital Discount is not liable for any damages or injury that may result in the operation of a higher untested operating speed. Digital Discount provides no warranty what so ever for its computers. Individual parts may or may not have a manufactures warranty. After the 7 day return policy has expired the computer is As-Is and is not eligible for a return or refund. Digital Discount provides no tech support for its computers, the instructions page and manuals accompanied by the computer are the extent of support provided by Digital Discount." do i have to get that approved or something???

  1. You can say all except the "After the 7 day return policy has expired the computer is As-Is and is not eligible for a return or refund" part. Well, you can say it all you like but if the computer breaks due to hardware failure then they are within their rights, guaranteed by the law in most countries, to get a refund.
  2. a; anyone can sue anyone anytime for anything. in 99.9% of all cases like you are talking about, those are called frivolous lawsuits and you would seek a "summary judgment" in your favor. b; if you sell your computer as used, you eliminate 99% of all liability. where are you getting your computers from?
